美國國家社會主義黨訴斯科基村案（National Socialist Party of America v. Village of Skokie），編號432 U.S. 43 (1977)，是美國最高法院在1977年6月14日處理宪法第一修正案有關言論自由與集會自由的重大判決，源於一個猶太村在縣級法院取得了禁制令阻止納粹主義遊行活動舉辦，但州級法院有意無意拖延納粹遊行方的上訴。判決確立了一個原則：當禁制令關乎言論自由时，下級法院必須馬上聆訊，不得拖延。[1]案件最終發還至伊利諾伊州最高法院（英语：Illinois Supreme Court），裁定展示「卐」（歷史悠長的符號，近代被納粹黨採用）的納粹主義遊行屬憲法第一修正案所保障的言論自由，准許舉辦。本案是大學憲法學課程的經典案例。[2]

爭執背景

事源1977年3月，美國伊利諾伊州斯科基村（英语：Skokie, Illinois）——以猶太裔為主的村而且不少人是納粹集中營的生還者[3]——村裡的納粹組織向警察申請在該年5月1日舉辦三個以「言論自由」為名的遊行活動。同年4月28日，[4]斯科基村政府向庫克縣縣級巡迴法院要求頒布緊急禁制令並成功。[5]該村政府亦藉機在同年5月2日通過三條條例，對遊行活動作苛刻限制。[6]第一條是遊行活動不能穿軍服，[7][8]第二條是禁止散布「仇恨言論」的材料； 第三條要求所有遊行活動必須購買$35萬美金的公共安全保險。[8][9]由此令該納粹遊行活動難以舉辦。[7]

納粹團體美國國家社會主義黨獲美國公民自由聯盟（ACLU）的協助上訴，州上訴庭、州最高法院拒絕馬上受理，從而實際上令該遊行活動在原定日期被取消，由此上訴至聯邦最高法院。[10]美國公民自由聯盟派出美國黑人民權運動律師——而且是兩個猶太人[11][12]——大衛·戈爾德伯格（David Goldberger）[7][13]與伯頓·約瑟夫（英语：Burton Joseph）（Burton Joseph）[14][15]主理。大衛·戈爾德伯格收到大量仇恨言論的電郵、恐嚇和滋擾，其中最常見的是批評「你身為猶太人怎能為納粹主義者辯護？」[12]美國公民自由聯盟有數千會員愤而退会。[12]

1977年6月14日，以5比4的票數，聯邦最高法院裁決規定州政府在對於限制美國宪法第一修正案權利——例如集會自由——頒布禁制令之前，必須採取措施保障程序公義，包括要州法院立刻對該禁制令作聆訊，否則禁制令必須暫緩。[1][10][16]

由此，聯邦最高法院將本案發還至伊利諾伊州上訴法院（英语：Illinois Appellate Court）去聆訊。[17]由於查普林斯基訴新罕布什爾州（英语：Chaplinsky v. New Hampshire）（Chaplinsky v. New Hampshire）確立了政府可以限制美國宪法第一修正案的數種言論類別——包括「挑釁滋事言論」（fighting words），伊利諾伊州上訴法院裁決「卐」（歷史悠長的符號，近代被納粹黨採用）因為會造成可預見的激烈反應，屬於「挑釁滋事言論」，從而不受美國宪法第一修正案權保障，[18][19]但是該黨可以舉辦不展示「卐」的納粹主義遊行活動。[20][21][22]然而，伊利諾伊州最高法院（英语：Illinois Supreme Court）推翻了上訴法院的判決，裁決「卐」並不構成「挑釁滋事言論」，因為聆聽者的感受並不能用所「挑釁滋事」的考慮準則，尤其是在當地村民早已獲知當天會展示「卐」的情況之下。[23][24]

其後，斯科基村的三條苛刻的遊行條例（不能穿軍服、禁止散布「仇恨言論」的材料、必須購買$35萬美金的公共安全保險），在科林訴斯密斯案（Collin v. Smith ）裡被判違憲。[25]最先由伊利诺伊北区联邦地区法院判違憲，[26]再由联邦第七巡回上诉法院判違憲，[25]聯邦最高法院沒有受理進一步上訴。[27]

法律以外的影響

此次裁決與游行活動促使斯科基村在1981年蓋成伊利諾伊州猶太人大屠殺紀念館與教育中心（英语：Illinois Holocaust Museum and Education Center），至今仍在營運。[28]
