擔任司法部長（英語：Minister of Justice；法語：Ministre de la Justice）職務的官員為負責司法部的部長，同時會兼任檢察總長（英語：Attorney General；法語：Procureur général）^[10]。司法部長暨檢察總長的職責為代表官方（加拿大君主）提起刑事檢控，並擔任加拿大政府的首席法律顧問。檢察總長的大部分檢控職能已下放予加拿大檢控署，檢察總長在這一角色上得到刑事檢控專員（director of public prosecutions）的支持。^[10]

該職位設立於1867年，以取代西加拿大律政司和東加拿大律政司。

作為主管司法事務的內閣成員，司法部長需要關注政策問題及其與司法系統的關係。司法部長亦單獨持有「檢察總長」的頭銜。作為檢察總長，他擔任加拿大的最高檢控官及官方的首席律政專員。自聯邦成立以來，這些職分就一直聯繫在一起。在SNC—蘭萬靈事件之後，由於爭議， 前聯邦副總理麥莉蘭（Anne McLellan）獲指派以審查這些職位並準備一份關於他們是否應該分離的報告。最終，她建議這兩個職位保持合併。^[11][12][13]

這個內閣職位通常是為持有法律專業資格的人保留的，但也有例外。例如，祖·卡勒只在戴爾豪斯大學學習了第一年的法律課程，然後就轉到卑詩大學法學院，最後中止學業開始政治生活。^[14]

加拿大內閣另有加拿大公共安全部長（Minister of Public Safety），前稱加拿大法務部長（Solicitor General of Canada），其為負責管理聯邦政府的執法機構（警察、監獄及公眾安全）的內閣官員，與司法部長暨檢察總長分屬不同部門。
